Legal Reform of Productive Waqf Regulation in the Utilization of Fishermen's Assets

This research examines the legal implications of uncertainty in the regulation of productive waqf for the utilization of fishermen's assets in Indonesia, as well as efforts at legal reform. This research is a normative legal study emphasizing a conceptual and legislative approach. The research findings indicate that the absence of specific regulations can create ambiguity regarding the legal status of waqf assets, particularly with respect to ownership, management, and the distribution of benefits. Legal reform is necessary through the formulation of rules based on maslahah mursalah to realize maqashid asy-syariah, as developed by Jasser Auda, who emphasizes a responsive, inclusive, and sustainable system approach. Furthermore, the formulation of legislation must also draw on the theory of legal pluralism by harmonizing Islamic and state law, while considering the social realities of the fishing community. Legal reform also needs to integrate the aspects of substance, structure, and legal culture as proposed by Lawrence M. Friedman. This research recommends establishing comprehensive regulations for productive endowments in the public interest to ensure legal certainty and sustainably improve the welfare of fishing communities.
